Resolution No. 07- 224

WHEREAS, Iligan, is the home to major industries that produces steel, cement, coconut oil, flour, power, chemicals, plastic pipes, bricks and others. As to manpower needs, Iligan is among the cities in the country that possessed competent contractors, world-class engineers, highly-skilled carpenters, masons and technical men;

WHEREAS, in employing thousands of people, these companies generate revenue to the host barangays and the City Government;

WHEREAS, in doing their business, Iligan-based corporations are competing with corporations operating outside the city, in the process threatening the existence of some Iligan firms. Moreover it was also noted that some winning contractors of City Government projects are hiring skilled workers from other places, though such workers are available in IliganCity;

WHEREAS, patronizing products not locally-produced and hiring workers not from Iligan, siphon money out of the city, while local businesses no matter how small, strengthen local economies by circulating the economy within the city;

WHEREAS, for the city locally-based economy to develop and to lessen unemployment problem, there is a need to encourage local consumers to support local businesses and workers by patronizing goods and services of companies that use Iligan labor and Iligan made-products and to instill in them the habit of buying Iligan-made products;

WHEREAS, the Iligan City Government is embarking on several flagship projects, like the Water Improvement Project, Material Recovery Facilities, Government Center, and infrastructures like bridges and concrete roads, etc., the vital material components like steel, cement, pipes and the like are produced in Iligan City;

WHEREAS Section 43 of Republic Act No. 9184, entitled “ An Act Providing For The Modernization, Standardization And Regulation Of The Procurement Activities Of The Government And For Other Purposes” states:

“ Procurement of Domestic and Foreign Goods. – Consistent with the country’s obligations under international treaties or agreements, goods may be obtained from domestic or foreign sources and the procurement thereof shall be opened to all eligible suppliers, manufacturers and distributors. However, in the interest of availability, efficiency and timely delivery of goods, the procuring entity may give preference to the purchase of domestically-produced and manufactured goods, supplies and materials that meet the specified or desired quality”

WHEREAS on

March 14, 2007, a public consultation was held at the LegislativeBuilding where participants shared their ideas which were incorporated in the ordinance;

WHEREFORE, on motion of Member Orlando M. Maglinao, duly seconded by Member Wilfredo R. Bacareza;

BE IT RESOLVED, AS IT HEREBY RESOLVED, By the Sangguniang Panlungsod of Iligan, that the following City Ordinance be, as it is hereby ADOPTED and APPROVED:

CITY ORDINANCE NO. 07 – 5152

AN ORDINANCE MANDATING WINNING BIDDERS AND OR CONTRACTORS OF ILIGANCITY GOVERNMENT PROJECTS TO PROCURE ILIGAN-MADE PRODUCTS / MATERIALS.

Be it ordained by the Sangguniang Panlungsod of Iligan in its session assembled, that:

SECTION 1. This Ordinance shall be called the “Buy Iligan–Buy Local Ordinance of 2007”

SECTION 2. One of the Requirements in Bidding. – Bidder /contractor participating in the biddings of any City Government Projects, shall submit, as one of the requirements, the list of materials that can be procured for the said project in Iligan City, and the city’s eligible suppliers, manufacturers and distributors which could supply such materials.

SECTION 3. Buy Iligan-Buy Local – The winning bidder/contractor shall purchase Iligan-made products, in any of the following conditions:

1. Iligan-made materials possessed Products Standard (PS) markings or of equal quality with those produced from other areas;

2. Iligan-made materials or products are cheaper or at least have the same prices with those produced from other areas;

3. The Iligan City eligible suppliers, manufacturers and distributors could show they have the competence to supply the volume needed for the implementation of said projects;

SECTION 4. Submission of Delivery Receipts. – While the City Government project is in progress (every now and then) and after its completion, the winning bidder/contractor, shall submit to the City Engineer’s Office delivery receipts issued to him, as a proof of the purchase of Iligan-made products or materials

SECTION 5. Incentives. – There shall be given, as an incentive, a tax rebate as provided for by the Iligan Investment Promotion Code to the winning bidder/contractor who complies the provisions of this ordinance.

SECTION 6. Penalties. – Winning bidders/contractors who are found to have purchased materials not locally produced, in spite of the availability of such materials in IliganCity, shall be blacklisted and shall be barred from participating in any future biddings of City Government projects.

SECTION 7. If any provision of this Ordinance, or its application to any person, legal entity or circumstances, is held invalid, the remainder of this Ordinance, or the application of the provisions to other person, legal entities, or circumstances shall not be affected.

SECTION 8. Effectivity. – This Ordinance shall take effect ten (10) days after the publication of a local newspaper.
